对民办教育营利与非营利性的思考

摘要：民办教育能否营利的问题是民办教育实践及其立法规范中的争论焦点。本文从“非营利性”的一般概念出发，借鉴国外非营利组织及民办学校的经验，结合我国社会经济和民办教育的发展背景，对民办教育的营利与非营利性问题作出分析。本文认为，从理论和各国经验看，民办教育应存在营利性与非营利性两种不同的形式，在我国目前投资激励为主的情况下更应有营利性民办学校的存在；同时，为与教育法协调，文章也提出一些现实性政策建议。

Discussion on Profit or Non-Profit Characteristics of Private Schools
Abstract: Whether the private schools can make profit has been a disputed focus for a long time. The article goes back to the general concept of “non-profit”, comparing with conditions abroad, and combined with social and economic background for development of private schools in China, to analyze the characteristics of profit or non-profit of private schools. This article suggest that there should be two kinds of private schools: for profit and non-profit, especially when invest be the dominating stimulation. It also gives some policy suggestions for keeping accord with the Education Act.
