摘要：《法律的经济分析》这部享誉世界的法律经济学著作，将经济学运用于许多非市场的行为，如，犯罪、起诉、离婚、意外事故、反种族歧视法等等，从而为我们提供了一种有全新的、广阔的、全方位的视角。效益被看作是法律的基本价值，法律的效益价值理论和经济分析方法是法学研究理论领域和方法论上的重大突破。本文试图勾勒出波斯纳的法律经济学的思想轮廓，并对社会现实作出适当的反思，以求促进我国市场经济条件下的法治建设。

abstract ： economic analysis of law，the widely praised book ，focuses on economic analysis of nonmarket behaviors such as crime， the legal process， marriage， accidents and anti-racialism .it supplys us with a new and unconventional method to think of laws. posners doctrine about “economic analysis of law” insists that efficiency should be regarded as the basic value of law. its theory of efficiency value and method of economic analysis are a great breakthrough in law theory domain. this note is intended to outline posners theory and reflects on the social problems， in order to consummate the law of market economy. key words ： economic analysis of law； ponsner； economic analysis； efficiency
