有限的宪法典与宽容的宪政制度——以“全球化”为概念性工具的分析

内容提要：“有限的宪法典与宽容的宪政制度”所隐含的核心观念是宪法学的研究应该更关注制度的建构，只有宽容的制度才能为宪法典的发展提供必需的空间，从而更有利于实现宪法的精神和原则。本文以全球化所带来的权力关系和权利类型的变化，以及公民权利保障机制的世界性发展和当今中国权利保障的宪法外的发展为例，说明了宽容的宪政制度的重要性。宽容的宪政制度从抽象的文化视角上看，是指这一制度能够客观的看待、反映和容纳文化进化过程中文化冲突的普遍性，能够提供一种公共的政治空间，每一个个体不管文化观点如何，都能够在这一制度框架中寻求保护自己权利的方式。从具体的制度运行的机制的视角上看，则应该包括平等的利益表达机制、合理的利益协调机制和有效的权利救济机制。

abstract：the core idea of the topic“limited constitution and tolerant constitutional government”want to express that the research of constitution should pay attention to system‘s development，only tolerant system can offer the essential space for constitution development，and is in favor of realizing constitutional spirit and principle. this article takes the power relation and the right type’s changing because of globalization，and civil right protected mechanism‘s developments in the world，and the right protected mechanism’s development out of the constitution in china as examples，wants to explain the system‘s importance in tolerant constitutional government. the tolerant constitutional government sees from the abstract culture angle of view，is that this government can treat，reflect and accept the catholicity of culture clash，can provide a kind of public political space，each one ignores how culture standpoint is，can look for the protection of his/her right in this government. from the concrete system circulating angle of view，is that this system should include the equal benefits expression mechanism，reasonable benefits coordination mechanism and efficient right relief mechanism.
