内容摘要：在“法治道路”这样一个很大的国家宪法论文字眼下面，本文运用横向与纵向的国家宪法论文分析比较，理论与实际的多维连接，主次矛盾的辨证关系与联系发展等方式和角度，讨论了以下几个具体问题：东方的法与西方的法在起源，和性质上的区别；中国社会的变革规律；法在中国社会不同的发展阶段扮演着什么样的角色；中国法治道路的具体展现；怎样推进中国的法治化进程。
文章站在一种本源的角度上，创造性的引入了中国的“人界”式发展道路与西方的“物界”式发展道路的概念，进而归纳出了各自的法治道路：即西方的纵深决定型法治道路，东方的展扩辅助型法治道路。又通过深刻的剖析，将中国社会的发展脉络及法治道路的变换轨迹划分为七大阶段来进行深入的展示，其中的第六阶段与第七阶段是预见性的提出来的。文章最终把落脚点定位于当今中国所处的法治阶段，点明了当今中国最可利用的法治资源，也阐明了现阶段中国法治道路的具体推进方式。

content summary ： under such a very big wording of “road governed by law” this text uses horizontal and vertical analysis to compare， the theory is connected with real to multidimensional link degrees， the way and angle that the dialectical relation of contradictions between primary and secondary is developed with getting in touch ，etc.， have discussed the following several concrete problem： the differences of origin， concept and content between laws in west and east； what‘s role that the rule and the law of china’s society changing plays in different stages in the developing process of our society ；the representing concretely of the road governed by law of china； how to advance the ruling by law of china. standing at the angle of origin，this thesis creatively introduces people circle road and western thing circle concept of road of type of chinese style， and has summed up one‘s own roads governed by law： namely the western determining type road governed by law of depth， the exhibition in the east expands the road governed by law of the auxiliary type. through deeply analyzing， vary chinese development train of thought and governed by law road of society orbit are went on the deep show to come through seven major stages， and passage six and passage seven are described by foresight. at last， this article nowadays orientates the temporary lodging as the stage governed by law that china is in， has pointed the most usable resources of rule by law in current china and also expounded the concrete promotion way of the road governed by law in china

序 言
“依法治国”的思想从法学界的学术话题上升为国家的治国方略，这可能是中国的法学家最激动不已的事情，也是中国法学界的骄傲。关于依法治国和法治国家的问题，当前的法学家们（主要是法理学家）大致正在做两件事：一件是编制法治蓝图，比如，说明什么是法治国家，法治国家的特征、价值和方向，它代表了法治国家理论中的价值研究的方向；另一件是剖析法治现实，分析从人治到法治转型过程中的现状、路径与未来可能出现的实际走向，它代表了法治国家理论中的实证研究的方向。也有许多人把两件事结合在一起来做，把法治目标问题与法治现状的分析结合起来思考。应该说，无论哪一种方式，其成果都是有目共睹的。但是从另一个角度讲，或许在更多的现实的中国人看来，法学家谈的“法”无论从效力上还是从认同的程度上又都倍显乏力。于是在本文中，我试图尝试一下从社会发展道路的本质规律的角度引出法治道路的本源，并在理论上介定出它不同类别与阶段的特殊性，进而从一种更宏观更深刻的角度来把握中国式的法治道路的位置与走向，或许这样的方式和理论更适宜并有助于当前国人的法治观念和信念的认可与增强。
