Medical Moral Perplexity: the Conflict between Utilitarianism and Deontology
Abstract: The disputing between utilitarianism and deontology is basic conflict in ethnics’ theory, with the same so as the modern medical ethnics. Medical humanism is always the basic spirit of medical ethnics, confronting the utilitarianism and axiology, how to resolve the controversy has different attitudes. Among them, the general viewpoint is to meditate the conflict; someone even attempts to use urelative ethnics, eclectic ethnics to resolve the conflict at all. This attempt is actually in vain. The utilitarianism led into the modern medical ethnics or bioethics cannot displace the medical humanism in token of deontology. In modern diversified medical moral theories, how to pursuit “reasonable balance” based on medical humanism is the fundamental outlet of the contemporary bioethics.

医学伦理学与生命伦理学的理论研究一直是国内研究的薄弱环节。作为应用的规范的伦理学，道德理论与原则体系的研究是一项基础性的工作。而作为医学伦理学与生命伦理学最基本理论的人道主义和功利主义，是各类相关著作与论文提及最多的概念。但在理解两者之间的关系与作用方面，存在不少误区。
1．义利之争：生命伦理思想的基本对立
现代医学伦理学或生命伦理学兴起的一个基本背景就医学道德难题的涌现。可以说该学科兴起的一个重要原动力是现代医疗生活面临着大量的医德的难题，需要有这么一门学科，这么一群人着力研究，寻找合理的道路，正如首次提出生命伦理学的Potter所说，“生命伦理学是为人类更好的生存开处方”。
现代医疗生活的复杂性使得伦理学进退维谷，使得分析或判断的结论往往莫衷一是。所以现代医学伦理的焦点演变为解决医德难题。美国上一个世纪70年代发生的“爱琳案件”可以看作一个起点[1]
