浅谈网络传播的社会管理

随着因特网的迅速发展及其对人们社会生活的影响日益凸现，因特网的社会管理问题，已在世界范围内引起关注。本文聚焦于因特网的一些基本特点对网络传播的社会管理的挑战，并讨论对网络的社会管理中法制建设同自律/道德建设及技术手段的关系。文章指出，中外许多有关研究和讨论都注意到了因特网的跨地域、跨国界的传播特点给网络管理带来的困难，但是，因特网的另一基本特征，即融合性特征，同样同网络管理的困难重重紧密相关。本文还指出，在重视自律与技术手段在网络管理中的作用的同时，必须认识到法律框架在这个问题上的指导作用并强调法律建设和道德建设并重的重要性。
Abstract
As the Internet develops rapidly and exerts increasingly great impact on people’s social life, the issue of Internet regulation/governance has received much attention throughout the world. This article focuses on some basic characteristics of the Internet and the challenges these characteristics pose to Internet regulation/governance. In addition, it discusses the relationship between legal regulation, (industry) self-regulation, and the use of technological means in Internet regulation. It points out that while much related research and many related discussions have observed the challenge to Internet regulation brought by this new, global medium’s capacity for cross-border, world wide communication, another basic characteristic of the Internet, i.e., integration, is also closely related to difficulties in Internet regulation/governance. Moreover, it also holds that while paying attention to the functions of (industry) self-regulation and technological means, we must recognize the fundamental guiding function of legal regulation and emphasize the importance of laying equal stress on both legal regulation and self-regulation in Internet governance.
