中美环境影响评价程序的对比分析

摘 要：2005年2月全国范围内掀起的“环保风暴”将公众的视线集中到了环境影响评价，该制度肇始于美国，其功能和作用早已为实践所证明。70年代后各国纷纷引入环境影响评价制度并制定了相应的法律法规，中国就是其中之一。尽管如此，由于在政治体制、经济水平以及社会文化等方面存在不少差异，中美的环境影响评价程序出现很多不同。本文从现行中美的法律规定出发，探讨该程序差异的体现，分析差异的成因并就完善中国环评程序提出借鉴意见。

Abstract: The“Environmental Protection Storm”surged in Feb.2005 put the citizens’ attention to Environmental Impact Assessment system which originated from United States; the practice proved that EIA is very important to the government. After 70th lots of countries were imitative of EIA and had passed many laws or regulations about it, including China, however, there exists plenty of differences between Sino-us EIA procedures because of differences in political system, economy, and social culture. This article tries to analyze the current difference and its causes based Sino-us rules, finally comes up with some suggestion to Chinese EIA procedures.
