Certainty About Uncertainty?--- The Precautionary Principle in Australian Environmental Law

Stuart Menzies Introduction In the last two decades sustainability has emerged as a key concept and objective shaping environmental policy. Many of the principles of sustainability have become part of international and domestic laws. Among these, the ‘precautionary principle’ has emerged as one of the most significant in terms of directing environmental decisions, but at the same time one of the more difficult concepts for decision-makers to apply. Inevitably an increasing number of cases involving the precautionary principle have been brought before the courts, however, judicial decisions have not necessarily provided clear direction on the issue.
